Twenty-Five Years, Sixty-Eight Boxes

For 25 years New Yorkers have asked City Hall what they knew about the air quality following 9/11. They filed countless records requests along with lawsuits—and essentially got nothing. Here’s part of why. In 2002, the Law Department ordered city agencies to funnel all 9/11 records requests to one lawyer, and to report back on anyone who so much as called asking.

Then last year, 68 boxes that held part of the answer showed up at the NYC Department of Environmental Protection.

On Tuesday, Mayor Zohran Mamdani posted the first 170,000 pages from the 9/11 files online. He also settled two lawsuits 9/11 Health Watch filed to get access to them.

“People got sick because the leaders they trusted lied and told them they were safe to breathe in toxic air,” Mamdani said.

We pulled one of the most damning documents from the stack, the one being called the Harding Memo. It went to Deputy Mayor Robert Harding in the fall of 2001—reporting that the city’s lawyers had counted around 35,000 potential plaintiffs and expected 10,000 of them to file.

The memo then lists the lawsuits City Hall was bracing for. Third on that list was “health advisories caused individuals either to return to the area too soon (causing toxic exposure or emotional harm).” Fourth was that “rescue workers were provided with faulty equipment or no equipment (i.e. respirators).”

The Giuliani administration was still urging people back into Lower Manhattan, while its own memo had already filed that advice under liability.

Jon Stewart, standing beside Mamdani, said what that meant for folks on the ground. “There was poison in the air, and on the ground, and in the window sills, and in your air conditioners and covering your pets and your clothes, and it stayed there for months. Everyone knew. Now it’s very clear that the city knew as well.”

Then there was the plan. The first recommendation in the memo was getting Congress to build a victim compensation fund modeled on the airline bailout. The memo noted that anyone who took money from such a fund would waive the right to file a civil action against the city.

In a statement released by City Hall, Dem Rep. Jerry Nadler accused former Mayor Rudy Giuliani of “intentional obfuscation of the truth.” That’s putting it nicely. New York disbarred Giuliani, as did DC. Not to mention the fact that a jury ordered him to pay $148 million for lying about two Georgia election workers.

2,977 people were killed in the 9/11 attacks. Thousands more have died due to what they breathed in the months after.

Mamdani opened boxes that should have been public decades ago, after being on the job for only eight months. The records didn’t change. Neither did the law. What changed was who New Yorkers put in charge.

The Violence They Didn’t Ask About

Around 140,000 people depend on the World Trade Center Health Program, so it’s a tragedy that HHS head Bob Kennedy is now running it. In his first year at the helm the program fired staff and rehired them numerous times.

By March the program was down to just 84 staffers filling 120 funded positions, while enrollment into the program climbed.

Benjamin Chevat from 9/11 Health Watch spent a year hammering Kennedy with letters. Lawmakers in both parties eventually piled on. In April, Kennedy lifted the hiring freeze. Pressure does indeed burst pipes.

There are some things Kennedy never needed to be pressured into asking for.

On August 26, HHS released a 24-page paper that wasn’t peer reviewed. It is being pushed as showing that support for transgender people goes hand in hand with excusing political violence.

This whole paper rests on five survey questions that the authors describe as measuring views on “medical interventions.” They don’t name a single medical treatment. There’s nothing about hormones, surgery, or even doctors.

They simply ask whether rejection hurts, if you should use somebody’s name, and whether parents should stand by their kids. The survey then asks about six kinds of violence, all of it from the left. Nothing about Jan 6. Nothing about clinics or Pride.

One more thing. Of the 1,208 adults surveyed, 13 were transgender or gender-nonconforming.

HHS’s own press release admits the “study” never checked if any respondent ever did anything violent, which seems pretty important here.

None of the five authors would answer interview requests from The 19th, a nonprofit newsroom covering gender and politics. Neither would HHS. But one of them, Colin Wright of the Manhattan Institute, had already given a quote to the New York Post, which obtained the paper before it was public.

Wendy Via runs the Global Project Against Hate and Extremism. “I would call it pseudo-science,” she said. On what comes next: “I don’t doubt that they will try to act on this in some way.”

The Post, the Daily Caller, Blaze Media, and the Washington Examiner are all citing it, which is exactly how it’s being used. We read it so you don’t have to take their word for it. It’s pure propaganda with a government seal on it.

67 Million Registrations Run Through A Broken File

For years, the Social Security Administration (SSA) has said it can’t tell who is and isn’t a citizen. Its own inspector general once estimated 3.3 million naturalized Americans were logged as noncitizens—with 25% of SSA files listing nothing at all. And if you were born before 1981, or became a citizen after you got your card, it could become a major problem for you.

SAVE is a federal database that was built to check if someone who was born abroad qualified for benefits. You could run only one name at a time.

Just last year, Homeland Security rebuilt the database to run a million names at once, and matched those to Social Security files. In March of this year, Trump ordered them to use it to list every eligible voter in every state.

Since April of last year, at least 25 states have run about 67 million voter registrations through it.

Anthony Nel came here from South Africa and has been a citizen for over a decade. Texas ran its rolls through SAVE, the file flagged him, and his registration in Denton got canceled. He fought and got it back.

Then in June a federal judge pulled the plug on the new version. Judge Sparkle Sooknanan found the government broke three laws building it. They “knowingly trampled on the privacy rights of American citizens in a manner that threatens the sacred right to vote,” she wrote.

It’s been off ever since. The regime appealed and lost again Friday, 2-1. One judge, appointed by Trump, sided with them and said anyone wrongly flagged could just go prove they’re a citizen. Nel already did. Once was plenty.

So this week they went to the Supreme Court to get it switched back on before the midterms. Standing in the way is the League of Women Voters, founded in 1920 by women who’d just won the right to vote. They have until 4pm Tuesday to answer.

They Beat The Gerrymander Twice

Trump has been hunting for House seats in states run by Republicans, and Missouri went on a mission to build him one. Gov. Mike Kehoe called a special session, and the legislature carved up Democratic Rep. Emanuel Cleaver’s Kansas City district, scattering pieces of it into rural counties. By the AP’s math, around 59% of that district’s voters were new to it.

So the group People Not Politicians got to work, gathering thousands of signatures to fight back. They turned them in last December, and demanded a statewide vote on the map itself.

The petition was thrown out by Republican Secretary of State Denny Hoskins. He claimed the state constitution bans any referendums on congressional redistricting. He made the announcement on primary day, while Missourians were already voting under the lines he had wanted.

The Missouri Supreme Court ruled against him, unanimously. “If the petition is sufficient, HB 1 never took effect,” they wrote. The map “is not the law and has never been the law.” The court noted Hoskins had “delayed certification until the last possible date,” and called his arguments “wholly unpersuasive.”

State Attorney General Catherine Hanaway begged Justice Brett Kavanaugh to rescue the map. On Tuesday, he said no.

A Trump-appointed district judge ordered the state to use it anyway only minutes later. Hoskins immediately emailed local election officials telling them to use the gerrymandered map, claiming the federal order “takes precedence” over his own state’s highest court.

That’s when People Not Politicians moved for contempt in state court, and took Clark’s order to the Supreme Court. On Thursday morning, the justices froze it—a brief order, no noted dissents, even after the Trump regime filed a brief backing Hoskins. Missouri goes into November under the 2022 map, and Cleaver’s Kansas City district is still intact.

“The law is the law, the Missouri constitution is clear, as was the Missouri Supreme Court,” said Richard von Glahn of People Not Politicians. Hoskins, he added, “has shown that he cannot effectively do the job he was elected to do.”

And Hoskins already certified the referendum as Proposition A. So Missourians get the old map in November and a vote on the gerrymander itself, on the same ballot. Clipboards—and more importantly, the people holding them—put both of those there.

Look at what has done damage to the regime this week. Cardboard boxes, a court ruling, five survey questions, and petition signatures. All of which landed harder than anyone expected.

They Gave ICE 47,000 Addresses. A Court Shut It Off.

In January, ICE broke down ChongLy Scott Thao’s door in St. Paul, Minnesota, and walked him into the snow in his underwear and Crocs while wrapped in his grandson’s blanket. They had the wrong man. Thao is 56 and a naturalized US citizen. Agents checked his ID later that same day and then drove him home. There was no apology given.

One of the men they were looking for during this raid had actually been in prison since 2024.

Federal Judge Indira Talwani cited the arrest when she blocked the IRS from giving ICE any more addresses. Then she went further, ordering ICE to stop using the data it already had.

Talwani was the second judge to shut it down. The first was Colleen Kollar-Kotelly, who in November ordered the IRS to stop the transfer and tell ICE in writing that handing over that data broke the law.

After Nixon’s Watergate scandal, Congress locked down the IRS so no president could ever use tax files to attack their enemies. Last summer, then-acting ICE director Todd Lyons asked the IRS for the last known address of around 1.28 million people. The IRS built a machine to fill the order, and only checked one thing about each address ICE supplied—whether the box had five or nine digits. Any digits. Kollar-Kotelly wrote ICE could’ve typed “Don’t Care 12345” and still gotten a home address back.

47,289 records went out. In more than nine of ten, nobody checked if the addresses ICE supplied were real.

Just yesterday a federal appeals court upheld Kollar-Kotelly unanimously. The lawyer for the regime admitted that the data transfers were unlawful. He then said three times he had no idea whether anyone had ever actually fixed the machine that processed them.

Our tax returns are not a weapon Trump can use against us.

They Sued Her With A Memo That Says It Doesn’t Count

In February of this year, New Jersey Gov. Mikie Sherrill ordered every state agency she controls not to let ICE into nonpublic areas of state property, or let them use it as a staging ground for raids. Agents were required to have a warrant signed by a judge. Anywhere the public could go, ICE could go, same as anybody.

Just 12 days later, the regime sued her. Their case relied heavily on a memo signed by then-acting ICE director Todd Lyons. Page three of that memo says it’s for internal ICE guidance only. It adds that ICE can cancel it at any time without telling anyone, and that no one can use the memo in court to claim a right to anything.

Then they took it to court to claim a right to something anyway. And page one gives up the game. It admits ICE goes to courthouses precisely because some states and cities refuse to hand people over from jail. The courthouse is the workaround.

On Friday, Judge Georgette Castner threw out the regime’s claims and dismissed the case with prejudice—they can’t sue again. Congress built immigration enforcement to run on states coordinating on a voluntary basis, she wrote. New Jersey said absolutely not—and that’s exactly what the law allows.

What ICE wanted was to take over the back hallways of state courthouses, where people go to fight an eviction or testify against somebody who hurt them. So in New Jersey, if you have to be in court on a Tuesday morning, you can walk in the front door and no agents will be waiting for you in the back.

Trump Pardoned Him. New York Convicted Him.

Thomas Sibick just picked up another felony conviction. But Trump can’t do anything about this one.

During the Jan 6 attack on the Capitol, former DC police officer Michael Fanone was yanked into the crowd and beaten unconscious. He suffered a heart attack and a brain injury, and left the force 11 months later after 20 years on the job.

While the mob surrounded him, Sibick took Fanone’s badge and radio off his vest. Later, Sibick lied about it, changing his story three separate times. He claimed he hit the emergency button on the radio to get help, but records show it went off around 16 minutes after others had already walked Fanone to safety. That was one minute after Sibick posed for a picture with a Capitol Police riot shield.

Sibick buried the badge in his backyard, then bought a metal detector so he could dig it back up when agents started to close in on him. He was arrested, and Judge Amy Berman Jackson sentenced him to 50 months.

Trump pardoned him after he had served 18, along with more than 1,500 other rioters.

Erie County, New York had him on charges Trump can’t erase. After a domestic incident in June, a judge ordered Sibick to turn over every gun he owned. Police pulled two semi-automatic rifles and loaded large-capacity magazines out of the house. In August a grand jury charged him with six felonies and a misdemeanor. He was held without bail. On September 2 he pleaded guilty to the highest felony and the misdemeanor. Sibick now faces up to seven years in prison. Sentencing is November 17.

Trump’s pardon works on federal crimes—not on state ones. Prosecutors in 50 states never need his permission.

Three Thousand People Keep Their Care

Trump’s big ugly budget bill ripped away more than a trillion dollars from health care and food help across the country. It stuck states with enormous bills just to carry out the cuts that states like Washington never wanted.

Gov. Bob Ferguson said Trump’s scheme is to make Medicaid hard enough to navigate that people who qualify stop trying. Nobody has to be denied, they just have to give up. Ferguson calls what Trump and Congress did morally bankrupt.

There were around 14,000 lawfully present immigrants in the state set to lose their insurance on October 1 due to Trump’s mess. State health care workers and community groups sat down with people to walk them through the confusing forms. Thanks to them, 3,000 people have kept their coverage. They’re still working on the rest.

On Thursday, Ferguson signed an order to keep all of that work going. It sets up a committee that will track every person losing health care, and do what they can to get them covered. Ferguson signed it at a community health center in Seattle’s Chinatown-International District, where more than half the patients are on Medicaid. The clinic serves people in over 90 languages.

Ferguson also urged people to open their mail. Under the new Trump rules you have to prove that you qualify twice a year. If the form doesn’t get sent back in time, you’re dropped from coverage. So if you or anybody you love is on Medicaid, open your renewal letter.

A state can only patch a hole like this. Closing that hole takes Congress. November is coming.

The midterms are going to be here before we know it. As of now, if we all show up and vote—we will win. But we have to keep working as if we are behind, and we must sprint through the finish. That’s why we need all hands on deck to support our reporting and organizing here.

A Power Company Sued A Nurse. She Won.

A Google data center is going up near West Memphis, Arkansas, and residents keep being told someone else is covering the cost for power. Jessica Kivell, a nurse, got curious, so she asked the state for paperwork.

The state sent Kivell the documents. She handed them to Sydney Sasser—a reporter at the Arkansas Democrat-Gazette—who published them on August 31. The paper reported on Google covering $526 million for a $1.6 billion solar plant that was built to feed the data center.

It also reported that power company Entergy was charging its customers $5.77 more per month since June that went to three new power projects—one of them the solar plant intended for the data center. Entergy wants a retraction. They claim the math is wrong.

Entergy filed a lawsuit the next day, asking the judge to rule before Kivell or the newspapers could speak about it. They also demanded the article be taken down from the website, and asked the court to make all five defendants name anyone they shared the documents with. Their brief never mentioned the First Amendment.

But presiding Judge Lee Rudofsky did, calling it prior restraint and saying the matter was one of significant public concern. Kivell sat through the hearing in her work scrubs. Rudofsky refused to order the story taken down or to issue a gag order. A day later Entergy abandoned its bid for an injunction.

One person, one records request, and that story is still up.

Two Neighbors Beat A City That Sued Them

Two Johnson County, Kansas residents—Carrie Schmidt and Kimberly Twente—wanted Edgerton to vote on whether a giant data center should go up there.

A Dubai-based developer—DAMAC—wants to put one up for $860 million. It’s been in business with Donald Trump since 2013, when it started building his golf courses in Dubai—and in January 2025 its founder stood at Mar-a-Lago while Trump announced $20 billion in American data centers and promised to fast-track the permits. Edgerton would be its first in the United States.

All Schmidt and Twente needed was 73 signatures to get it on the ballot—they turned in 208. The county’s election office verified more than enough of them, and the county lawyers signed off on the form.

On July 23, the Edgerton City Council voted 3-1 to go to court over it. Twelve days later the city’s filing named Schmidt, Twente, and their nonprofit as defendants.

But on September 3, Judge Stephanie Goodenow put an end to it. Her order notes that instead of passing the ordinance or giving the choice to voters, the city sued. Goodenow found the city’s evidence to be conclusory and insufficient, and struck the case under a Kansas law that protects people who speak out. The judge also ordered the lawyer for the residents to submit his fees; she may make the city pay them.

The day before that hearing, the developer’s Kansas company hired a national law firm and filed 34 pages with the intent to join the case. The claims from the city were thrown out before the court reached that point.

Schmidt said she hopes every city attorney in Kansas is paying attention, because you cannot sue people over protected activities. On September 24, arguments begin on putting the question on the November ballot.

They Deported A Citizen. He Came Back.

Brian Jose Morales Garcia is 25 and was born in Denver, Colorado. This spring he was installing air conditioners in the sweltering Texas heat.

On April 3, his boss got pulled over near Fredericksburg over the car’s window tint. Brian was in the passenger seat. Troopers called in local police to translate, because he speaks Spanish—then they called ICE.

Brian’s birth certificate was sitting at his house. His family drove it over, but agents wouldn’t even look at it. His little girl and pregnant wife were waiting for him at home.

His lawsuit says agents told him he’d go to prison if he kept insisting he was American. He signed their papers rather than disappear for months. On April 7—four days after the traffic stop—they deported him to Mexico.

Then Brian hired lawyers who got him a hearing on Judge Robert Pitman’s calendar. Days before it arrived, the government agreed he could walk back in if he presented his birth certificate and a photo ID at the border. The same birth certificate the government refused to look at in April. On August 30, he walked back across the border into Texas.

Nobody had to look at his citizenship until a federal judge was about to make them explain. His damages case is ongoing.

The Librarian Who Wouldn’t Call A Book Dirty

Patty Hector’s been a librarian since 1985. She spent 15 years at Fort Smith, then some time in California before returning home to Arkansas, where she ran the Saline County Library.

In 2023, the Saline County Republican Women started demanding that books about race and sexuality be moved out of the children’s section. County Judge Matthew Brumley told Hector to get ahead of it and just pull the books from the shelves. Her complaint quotes him as saying it was regardless of legislation, regardless of law and ordinances.

Hector told a reporter that there was nothing wrong with those books, adding that every child should be seen and heard and supported. The response from the Republican women? They put up a billboard that read “Director Hector Must Go.”

Hector’s library board refused to fire her, so the all-Republican county legislature stripped the board of that power and handed it to Brumley. Before making any decisions, he called the Association of Arkansas Counties seeking advice. They told him he could terminate her for what she said publicly—he fired her days later.

Hector went from $44.43 an hour to $11.50 at another library. By the time she sued, that job was gone too. She needed therapy to get through it all.

Last October, a federal judge ruled a jury could find that ordinance was written to get rid of her personally. Only a week before the case went to trial, the county settled with Hector for $275,000. It was paid out of the same association’s insurance fund. Brumley says the county disagreed with her claims and was ready to fight.

They were ready to fight right up until a jury was about to hear the whole story.

Four stories that prove when people stand up, we can win. Trump is not unbeatable—we’ve beaten him before and we’ll do it again. But we need all hands on deck.

400 Emails Later, The Vote Was 7-0

Last week, Trump posted on social media that the only reason a community wouldn’t want a data center is if it wants to end up backwards and poor. The night after, seven members of the Planning and Zoning Commission in Prosper, Texas, took a vote on a data center.

A Dallas-area developer wanted farmland rezoned to put one up. It would cover roughly 225,000 square feet and cost around $580 million. Town staff had already recommended the project for approval. That’s usually where a story like this ends. But then more than 400 emails came in against the data center.

Dozens showed up to the commission meeting and spoke for over an hour, some coming from towns next door. No one could tell them how much electricity the data center would pull from the community, because the power draw depends on the tenant, and no tenant has signed. According to the developer, the entire project would only come with 20 to 50 permanent jobs.

Even Prosper Mayor David Bristol stood up as a private citizen and asked the commission to deny it. All seven members voted no. A half-billion-dollar project didn’t get a single yes vote. That recommended rejection is scheduled to be in front of the Town Council Tuesday night.

A Fox News poll in July found voters oppose building a data center in their area by forty points, 70 to 30. The group most likely to say yes was MAGA supporters, and even they came in under 50%. Prosper loudly said what most of the country is already thinking.

A 19-Year-Old Made A Former Governor Answer

When Jonah Bevin was five years old, he came to the US from Ethiopia—he’s 19 now. He spent time in boarding schools for troubled teens, including one in Jamaica that the police raided while he was in its custody.

Last year, a judge let him into his parents’ divorce case to ask for child support covering that time. His father is Matt Bevin, the Trump-endorsed former Governor of Kentucky.

Child support is calculated from what a parent earns. So the court ordered both parents to open their books. Jonah’s mother did—Bevin turned in a financial statement that was blacked out.

The judge ordered him again and he ignored her. So she held him in contempt in March, giving him more time. When Bevin blew that deadline, the judge issued a warrant for his arrest.

Bevin spent the summer refusing to show up to the courtroom. When his son took the stand in July, Bevin asked if he could watch via video—because showing up in person meant he’d be getting arrested. The judge said no.

Deputies arrested him Thursday on a Christmas movie set at a Kentucky horse farm. The next day, Judge Angela Johnson denied him bond and ordered him to serve 60 days. A former GOP governor is sitting in a jail cell rather than show a judge what he earns in a child support case brought by his own son.

California Beat The EPA And The Oil Lobby

California’s been setting car exhaust limits way before Washington, and federal law has protected that for 60 years now. California writes what is considered the standard, and the Clean Air Act requires the EPA to sign a permission slip unless it can point to one of a few narrow exceptions. It’s signed more than 75 of them.

Congress has a fast track for killing a federal rule—simple majority, no filibuster, done. It can’t do that to a permission slip, because a permission slip isn’t a rule. Each of these documents says so, in the EPA’s own words, printed in the government’s own record book.

So Lee Zeldin’s EPA took four of those waivers, one of them signed more than 15 years ago, and suddenly started calling them rules. Nothing else changed. Then the EPA mailed them to Congress for the fast-track treatment and stapled the original paperwork to the back—including the page that says it isn’t a rule.

Judge Beryl Howell blocked it and threw out two attempts to toss the case, which came from the EPA and the oil industry. Then the judge wrote that it might look like a clever policy move, but it undermines honest compliance with the law—which is what Americans should expect from executive branch agencies.

They didn’t just get caught. They confessed in writing and mailed it in.

A Judge Just Saved Mail Voting Again

Nearly a third of America votes by mail, and North Carolina put the first ballots out on Friday. In March, Trump ordered the Postal Service to screen them first. Before your state can mail you a ballot, it would be required to upload your name to a new federal portal. It would also need to get its envelopes approved in DC. Anything that doesn’t line up gets handed back to the state, which means it never reaches you.

Federal Judge Indira Talwani blocked Trump’s order in June, so the regime took it to the Supreme Court claiming they were being harmed every day they couldn’t act. Then, a few weeks ago on a Friday night around nine o’clock, the Postal Service issued its final rule. Three days later the justices ruled for the regime, saying states sued too early because no final rule existed yet. It had existed for three days.

Talwani had a word for that. Feigned. She wrote that the Court had accepted the government’s feigned compliance. And when election officials from more than 20 states swore that complying this late was impossible, she noted the government didn’t even respond.

On Friday, Talwani blocked the mandatory parts of the new USPS rules and refused to pause her order while the regime appeals. Likely unlawful, she found. Likely unconstitutional. And on this timeline, people losing their vote was practically inevitable. The regime is back at the Supreme Court as I write this. But as of now, no one can be forced into that portal, because the judge read the calendar and said absolutely not.

It’s been a long road to get here. But after a decade of fighting Trump and his accomplices, there’s no way we’re slowing down now.
