Trump Surrendered This Week and Hoped You Wouldn’t Notice
Eight wins, and the last one is the fight he walked away from

1. THEY COULD LOSE NEBRASKA
Republicans could lose a Senate seat in Nebraska they’ve never had to think about. Dan Osborn is a union guy running without a party, and two years ago he came within seven points of beating a Republican senator there. This month the Democrat in the race, Cindy Burbank, dropped out so he’d have a straight shot at GOP Sen. Pete Ricketts.
2. YOU CAN STILL REGISTER WITHOUT A PASSPORT
New Hampshire passed a law telling new voters to bring a passport or a birth certificate or go home. Judge Samantha Elliott threw it out. The state asked to keep enforcing it through November anyway, and she said no.
3. ICE HELD THE WITNESS. A JUDGE LET HIM OUT.
Jose Trinidad Rojas Pliego walked out of ICE detention Wednesday after three weeks in a cell. ICE had stopped the van he was riding to work in, an officer shot the driver dead, and Rojas Pliego saw all of it—so they locked him up. Judge Keith Ellison ordered him released, and the first place he went was the memorial for the man who’d been driving.
4. YOUR MAIL BALLOT IS SAFE IN 23 STATES
Trump ordered his own agencies to build a list of who counts as a voter, and told the Postal Service not to mail a ballot to anybody who wasn’t on it. Judge Indira Talwani killed that, the appeals court refused to bring it back, and now he’s begging the Supreme Court. Those ballots go out either way.
5. THEY’VE LOST THIS FIGHT NINETEEN TIMES
The DOJ has been suing states across the country to take private voter records. Judges have thrown them out nineteen times now without a single win. Two more came this week—New Jersey on Wednesday, Illinois on Friday, where the judge tossed the case for good.
6. A COURT KILLED THE $100,000 VISA TAX
Thirty-some people applied for a lab tech job at a hospital in Hettinger, North Dakota, and not one was American—and Trump had just put a $100,000 price tag on hiring anyone from abroad. Judge Leo Sorokin struck the fee down and the appeals court refused to revive it last week. Hospitals like that one can fill those jobs now.
7. THEY WENT FOR THE WATER AND GOT STOPPED
A company wanted to build a data center out by Spaceport America, and those things swallow enormous amounts of water in a stretch of New Mexico desert that hasn’t got it to spare. County commissioners were only supposed to vote on a letter of concern. Commissioner Sandy Jones pushed for a ban instead, and all three voted yes. Nobody’s building out there for 18 months.
8. HE QUIT ON BIRTHRIGHT CITIZENSHIP
Trump signed an order saying babies born here to immigrant parents aren’t citizens unless the paperwork is right. The Supreme Court threw it out 6-3. He swore he’d demand a rehearing IMMEDIATELY, and then he had 25 days to do it. Monday came and went with nothing filed. Those babies are citizens.
I’ve been at this since February of 2016, and mornings like this one are why. A decade in and there’s more good news now than there was a year ago. That’s not luck, and it isn’t going to hold by itself.
So here’s my promise. I’m not going anywhere. As long as this regime keeps doing its worst work where nobody’s looking, I’ll keep going in after it and putting the receipts in your hands.
