This is about so much more than Supreme Court reform.

This is about choosing democracy over chaos.

I'd certainly be Okay with Biden/Harris using the Executive Branch to reign in the Judicial Branch and over-ride some of the judicial branches erroneous decisions.

Even if trump doesn't make it into office, the Heritage foundation and their kind will benefit from every unethical behavior of the justices and their democracy-killing rulings.

I agree Janine. Let’s demand accountability from those we hire to do our good work…, setting examples based on law… not on their grifting!

The Constitution says Supreme Court justices serve in periods of "good behavior." There is no mention of lifetime appointment. Obviously, there has been lots of bad behavior. Time for Thomas snd Alito to be OUT!

Add a V.P. like Mark Kelly to seal the deal.

Absolutely needed. The corruption has to go, along with Thomas and Alito. Expand the court to 13, too.

I support expanding the court as well Christine!

To expand the court, Dems need to control both the house and senate. The Constitution gives the power to decide the make-up of the court to Congress. So, don't overlook those down-ballot races!

The utter duplicity of the current court in its support of the right wing agenda has undermined any defense they could rationally make. The immunity and Dobbs decisions were factually and legally unsupportable. How the court came to this its composition was unethical to say the least. Time to fix this.

Expand full comment

During the Clinton administration, the court decided that presidents can be held liable for civil violations even while still in office. But this court thinks presidents can't be held liable for crimes they commit while in office even after they leave? It beggars belief.

It also goes to show that this court majority is captive to their billionaire benefactors. That can't be allowed to stand.

No thinking about for too long, right now we have the Senate for confirmations to expand the court and pass the new guidelines, but we needs to do it before Nov. to ensure that edge stays.

Expand full comment

No - not before the election. One fight at a time, and when you're successful in a fight, it's because you chose the right time to have it.

Expand full comment

If we should lose the Senate it will never get done. If nothing else, evening out the court is necessary especially when you have 5 election deniers on it who would likely overturn an election if Trump loses and takes it through the courts.

Expand full comment

And if we have the fight now, it will energize the other side and we will lose the Senate. So go out and win the Senate in November, take the House and elect Kamala. And then we get to work.

Expand full comment

Or we wait and lose the majority after the election and it never gets done.

As far as energizing the other side, if they say anything blast back about them packing with known radicals who lied at their confirmation but got pushed through by McConnell.

Man oh man. You absolutely gotta love his timing.

I absolutely agree with president Biden and VP Harris. There is an old saying “fish rots at the head”. It would be lovely if over the break Roberts could locate his spine and actually deal with the rot this SCOTUS displayed. We got rid of a king 247 years ago. Their immunity decision was a joke. I thought they were supposed to interpret the constitution, not 💩 all over it.

I wish the reform could happen ASAP! I'm not sure what to do with fears of this election coming down to the Supreme Court in its current state. The Harris HQ Instagram yesterday shared a cryptic speech from the Heritage Foundation director, and it raised all my fears about the things they are trying to do to make this a legal fight. I've seen a few fears surrounding them trying to get this turned back to state electors (via the states with split votes and preventing 270 electoral votes).

I'm feeling so much hope and excitement, but now I don't know what to do with this new fear!

Do you think the kids who landed on Omaha Beach weren't afraid? And they did it anyway.

When I was a young sailor, an old Navy Chief explained heroism to me: "when you're so scared you've pissed your pants and crapped your drawers and your brain is frozen, and you do your job - that's being a hero."

Take your fear and turn it into energy to go out and participate in this fight.

Believe me that I am. I have been textbanking, sending postcards, attending organizing events. I'm as active as I've ever been. My fear isn't stopping me from doing anything. But these actions are all about getting out the vote and helping register people.

I have NO idea how I can help with this plan to throw it back to the courts. My "I don't know what to do with this new fear" is precisely that. I don't know what I can do to try to help the shady plans. If you have ideas, send them my way. Because I am happy to help all I can.

I can think of a couple of impeachments that would be a good start. And why do we no longer have as many SCOTUS justices as we have District Courts?

Expand full comment

This is probably the most important vital reform of our era which is necessary right now right here in this moment we are now living in. May this clear thoughtful plan go far and wide and may reforms be implemented asap. Supreme court judges need to be exemplary, of honesty and non partisan never corrupt in any way; now is the time to hold up the mirror to them and ask the ones who have been bribed and partisan to resign or face big consequences.

Now, we need to win the presidency, the House and the Senate (big), kill the filibuster and pass what can be passed, and build public support for those elements that require Constitutional amendments. Tough ask, but it has to happen.
